US EPA proposes approval of Vermont's PM2.5 air quality plan revision, 2016

The Environmental Protection Agency (EPA) is proposing to approve a revision to the State Implementation Plan (SIP) submitted by the State of Vermont. This revision specifically addresses the regulation of Particulate Matter 2.5 micrometers or less (PM2.5) under the Prevention of Significant Deterioration (PSD) preconstruction permit program, which is mandated by the Clean Air Act. The purpose of the revision is to establish the maximum amount of PM2.5 'increment' (the allowable increase in ambient concentration above a baseline) that new or modified sources obtaining a PSD permit are permitted to consume. Additionally, the revision introduces a requirement for sources to obtain PM2.5 emission offsets under certain specified circumstances. This action is being taken in accordance with the Clean Air Act. The affected sectors are primarily industrial facilities or other sources in Vermont that are subject to PSD permitting requirements due to their potential to emit significant amounts of air pollutants, including PM2.5. The deadline for submitting written comments on this proposed rule is October 14, 2016. The EPA notes that a direct final rule approving this SIP revision is being published concurrently in the Federal Register, as the Agency anticipates no adverse comments. If adverse comments are received on this proposed rule, the direct final rule will be withdrawn, and a subsequent final rule addressing the comments will be based on this proposal, without a second comment period. The relevant statutes and regulations involved are the Clean Air Act, State Implementation Plans (SIPs), Prevention of Significant Deterioration (PSD), and the regulation of PM2.5.

The Environmental Protection Agency (EPA) is proposing to approve a State Implementation Plan (SIP) revision submitted by the State of Vermont. The revision sets the amount of PM 2.5 increment sources are permitted to consume when obtaining a prevention of significant deterioration (PSD) preconstruction permit and requires PM 2.5 emission offsets under certain circumstances. This action is being taken in accordance with the Clean Air Act.

Written comments must be received on or before October 14, 2016.

In the Final Rules Section of this Federal Register , EPA is approving the State's SIP submittal as a direct final rule without prior proposal because the Agency views this as a noncontroversial submittal and anticipates no adverse comments. A detailed rationale for the approval is set forth in the direct final rule. If no adverse comments are received in response to this action rule, no further activity is contemplated. If EPA receives adverse comments, the direct final rule will be withdrawn and all public comments received will be addressed in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period. Any parties interested in commenting on this action should do so at this time. Please note that if EPA receives adverse comment on an amendment, paragraph, or section of this rule and if that provision may be severed from the remainder of the rule, EPA may adopt as final those provisions of the rule that are not the subject of an adverse comment.
