Republic of the Philippines DEPARTMENT' OF ENERGY DEYARTNZENT CJRCTILAR NO. QC 0 1 1- 04 - 0001 -b 4 MANDATORY USE OF HIOFUEL BLEND WHEREAS, Section 5.2 of Republic Act No. 9367 or thc "Biofuel's Act of 2006" provides: "Within four years from the effectivity of this Act, the NBB created under this Act is eiiipowered to determine the feasibility and thereafter reconlinend to DOE to inandate a inii~iiuuno~f ten percent (1 0%) blend of bioethanol by volume into all gasoline fuel distributcd and sold by each and every oil company ill the country." WHEREAS, tlie Department of Energy (DOE) recognizes and adlieres to the policy, objectives and mandate of the Biofuels Act of 2006; WHEREAS, afier extensive public consultation with all stakeliolders in 2009-201 1, including scientific tests and studies conducted by technical experts, the National Biofuels Board (NBB) established the viability of implemeilting tlie general mandate of ten percent (10%) for bioethanol sold and distributed by every oil company under specific ternis and coiiditions; WHEREAS, in a resolutio~ld ated February 3, 20 1 1. thc NRB recomme~ldedt o the DOE tlie implementation of the general inandate of ten percent (1 0%) blend of bioethailol for gasoline fuel under specific terms and conditjons and the conduct of f~lrtherp ublic coniultation to determine tlie feasibility of increasing the current two percent (2%) blend for biodiesel; NOW, THEREFORE, in consideration of all the foregoing, tlie DOE hereby issues, adopts and proinulgates the following mandatory use of biofuel blend: Section 1. Scope and Application. This Circular shall apply to all participants in the downstream oil industry and the local biofuel producers. Section 2. Adherence to Declared State Policy.
