Morocco: Law No. 16-09 Establishing the National Agency for Renewable Energy and Energy Efficiency (June 2010)

Law No. 16-09, promulgated in June 2010, establishes the National Agency for the Development of Renewable Energies and Energy Efficiency (Agence nationale pour le développement des énergies renouvelables et de l’efficacité énergétique) in Morocco. This agency is a public establishment with legal personality and financial autonomy, operating under state tutelage and financial control. Its primary purpose is to contribute to the implementation of the government's policy on renewable energy and energy efficiency. The scope of the agency's activities includes renewable energy, energy efficiency, and environmental preservation related to energy activities. Its key obligations and functions, as defined by Law 16-09, include: 1. Proposing a national plan, as well as sectoral and regional plans, for the development of renewable energy and energy efficiency to the administration. 2. Designing and implementing development programs in the fields of renewable energy and energy efficiency, as well as environmental preservation programs linked to energy activities. 3. Monitoring, coordinating, and supervising national programs, projects, and development actions in renewable energy and energy efficiency, in consultation with relevant administrations. 4. Carrying out promotional activities in the domain of renewable energy and energy efficiency. 5. Identifying, evaluating, and mapping renewable energy resources and energy efficiency potential. 6. Proposing national territory zones suitable for electric energy production projects from renewable sources to the administration. The agency was originally the Centre de développement des énergies renouvelables, established by Law No. 26-80 (promulgated by Dahir n°1-81-346 of May 6, 1982), and was renamed by Law 16-09. According to a subsequent amendment by Law No. 39-16 (date not specified in the provided text), the agency's name was changed to the "Moroccan Agency for Energy Efficiency" (ADEREE). Law 39-16 also set new objectives, including: * Making proposals for a national plan, and sectoral and regional plans for the development of energy efficiency. * Promoting the production of energy from renewable sources, its commercialization, and export by public or private entities. * Subjecting renewable energy production facilities to an authorization or declaration regime. * Monitoring and adapting technologies in the field of energy efficiency, particularly through the implementation of illustrative, demonstration, or incentive pilot projects. The affected sectors primarily include the energy sector, encompassing both renewable energy production (Energy Supply) and energy consumption (Energy Demand through efficiency measures). The law establishes the institutional framework (Institutions / Administrative Arrangements) for these activities. No specific deadlines or compliance dates are mentioned in the provided text or summary.
